A huge problem with some breath-alcohol testing machines used in the District could overturn hundreds of DUI / drunk driving cases.

Washington D.C. Police reports an audit revealed that 8 of the 10 Intoxilyzer 5000 breathalyzers used since 2008 had issues with their accuracy.

D.C. Police Chief Cathy Lanier says those breathalyzers were generating inaccurate results between October 2008 until they were taken out of service earlier this month.

"It's disappointing in some sense but I'm happy we caught it," says Lanier, "and happy we caught it when we did."

Those malfunctioning units, manufactured by Kentucky-based CMI, Inc., have been repaired and are now fully functioning.

David Benowitz, a local defense attorney with the Law Offices of David Benowitz, says that he wasn't surprised to hear that several breathalyzers weren't functioning properly.

In a released statement, Benowitz says he knew something was wrong when the Office of the Attorney General started dismissing DWI cases.

D.C. police are reviewing cases that could be affected, and Benowitz says that hundreds of convictions, dating back to 2008, could be overturned.

"This shows a callous disregard for the rights of D.C. drivers," says Jason Kalfat, an attorney from the same office as Benowitz, in a released statement. "For most defendants a breathalyzer score is the single most significant piece of evidence that can put you in jail, cost you money and damage your career."

Stephen Mercer, a seasoned criminal defense attorney, will be calling for independent investigation into the flawed units.

9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact an attorney ASAP.

8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.

Chargers Star Vince Jackson pleads guilty to DUI

San Diego's Pro Bowl receiver Vincent Jackson will receive 4 days in lieu of 96 hours in a work-release program, plus a probable NFL suspension this fall, after pleading guilty to his second California DUI offense since 2006.

Jackson, 27, also was sentenced to five years’ probation, a $2,408 fine and 15 days of community service stemming from his DUI arrest in January 2009. Because it’s his second DUI offense, Jackson likely will be suspended by the NFL, according to the league’s substance-abuse policy.

The suspension could be about two games, but his overall punishment could have been much worse. The San Diego City Attorney’s Office asked a Superior Court judge to punish him with “substantial custody” — as much as 180 days in jail — after hearing Jackson make comments in a local radio interview last month that prosecutors apparently considered irreverent, according to court documents.

In that interview with Darren Smith of XX Sports Radio, Jackson was making reference to a different incident: his traffic stop a few hours before the Chargers playoff game against the New York Jets on Jan. 17.

In that interview, Jackson said, “I’m sure that once it’s all said and done, we’ll definitely get the last laugh and hopefully our law enforcement will definitely continue to support us in the way that they have.”

Jackson’s San Diego DUI criminal defense attorney, Cole Casey, was advised that City Attorney Jan Goldsmith was “upset by the radio interview,” according to court documents that Casey filed. “Specifically, he was apparently upset about Mr. Jackson indicating in the interview he would ‘have the last laugh,’ insinuating, at least in the minds of the city attorney, that Mr. Jackson was laughing directly at the prosecutor’s office and law enforcement.”

As a result of that traffic stop, Jackson was charged with driving with an expired registration and a suspended license. (His license had been suspended as a result of his second DUI arrest.)

Jackson will plead not guilty next week to charges stemming from that traffic stop, Casey said.

Casey said “there’s a genuine issue in that case as to whether Vince knew his license was suspended versus whether it was restricted.”

Jackson’s DUI sentencing was standard punishment for a second DUI, Casey said. Court records show that Jackson didn’t get a jail sentence but is to serve 96 hours in a Sheriff’s work-release program, which in similar cases often constitutes roadside trash pickup over two weekends.

“Although the city attorney attempted to punish him for being a celebrity and making comments on the radio, he was treated as any other second offender,” Casey said. “He wasn’t given any special treatment, nor did he ever ask for any.”

Casey’s court filings also state that in the 14 years of his DUI law practice, including more than 7,500 cases handled with the City Attorney’s Office, he has “never experienced, on a misdemeanor case, a request to the Judge, by the City Attorney’s Office, for additional custody due to statements made by a defendant in contrary or in criticism to the city attorney’s positions or beliefs.”

Judge David Danielsen’s only remark about the case, according to the City Attorney’s Office, was that he was going to treat Jackson “like everyone else.”

“In light of the fact that Mr. Jackson still has a case pending our lawyers are unable ethically to discuss this beyond simply stating what occurred in the courtroom,” Goldsmith said in an e-mail.

Casey had fought the second DUI case last year on the basis that Jackson’s rights were violated after his arrest when his blood was drawn against his will with his arms handcuffed behind his back. Jackson had requested a breath test instead, as was his right, but a California Highway Patrol officer considered him to be slow-moving and recalcitrant with the breath test, so he administered the blood test instead.

The case was delayed by two continuances since November, helping Jackson avoid a conviction until after the football season. Casey’s court filing also says the city attorney wanted additional custody for Jackson because of the “amount of continuances that were requested.” However, the city attorney did not oppose any of the continuances at the time.

Jackson’s blood-alcohol content in January 2009 was measured at 0.17 percent, more than double the state limit. Jackson’s previous DUI conviction stemmed from his arrest in June 2006.

What are his or her California DUI qualifications?

Has he or she been a Specialist of the California DUI Lawyers Association?

How long has he or she been a member of the National College for DUI Defense?

How many years has he or she been handling DUI cases?

Has he or she taught other attorneys in California how to handle DUI cases?

Is he or she an Editorial Consultant to California Drunk Driving Law, "the Bible" of Drunk Driving Defense?

Step 2: Can I just use a Pubic Defender?

Public Defender?

If you think you can automatically get a Public Defender, think again. If you have a job or assets, you probably do not qualify.

If you apply for a Public Defender, you will have to swear under oath that you have no job and/or assets.

If you do meet the financial eligibilty criteria for a public defender for the Criminal Court side of your DUI case: (a) public defenders do not handle DMV matters; and (b) your court appointed attorney will not be available to discuss your DUI case with you until they have been officially appointed by the Judge no sooner than the date of your first court appearance, or arraignment.

Being that the 10 day grace period for requesting a DMV Licensing Hearing would have already lapsed, it is strongly recommended that you retain a qualified and proven a California DUI Attorney to represent your quasi-civil matter with the Department of Motor Vehicles.

Step 3: How can I avoid paying too much? (How to Get a Real Good Horse for a reasonable fee.)

Law Firms who advertise alot generally charge alot. A real high-priced "law firm" may be one:

a) With a large overhead (TV commercials, fancy offices in a higher rent district or a large, "full" staff).

b) Showing a Big City (e.g. Los Angeles) - based video or Super Lawyer from an out-of-county law firm whom you will never meet and deal with (and who will never personally appear for you in court or at the DMV).

c) Does the person in the firm with the "award-winning" record, knowledge and outstanding reputation actually get in the trenches for you? (It appears NOT in most cases. Have these firms became factories or mills representing a "figure-head"? Where is the Wizard of Oz? Is "The Great One" hidden behind a curtain?)

d) Which unfairly or unreasonably claims it will or may have to do certain things - but actually does not- just so it can charge you up-front for a Horse & Carriage when all you need is a real good horse for a reasonable fee.

Step 4: Does the Lawyer send out "Jail Mail" advertisements to your home address?

US Mail Privacy Warning: California Attorneys Mail You "DUI" Mail After Your Arrest! You may be feeling a little down. It gets more depressing when you see your mail. Don't want persons living at your home to know you were arrested? Hurry home. Why? Attorneys send "Jail Mail."

Lawyers pay $ for your name & address. They solicit you with outdated, invasive, and unreliable "DUI" letters.

Your mail box gets filled with embarrassing words printed on the envelopes: "DUI" "Drunk Driving" "Arrested" "Former Prosecutor" "Court-related " "DMV" "Legal Advertisement" "Urgent" "Law Offices" "Attorney"

Asthma inhalers & the California DUI breath test

Many asthma inhalers operate primarily by injecting a mist containing a substantial quantity of alcohol into one's lungs. This alcohol does not pass into the blood stream, but remains in the alveolar lining of the lungs; from there the alcohol will be exhaled into the breath machine.

California DUI breath tests are problematic as they are designed to assume that the breath sample contains alcohol which has been swallowed and then metabolized by the body before being diffused into the lungs.

California DUI breath tests also assume that there are 2100 units of alcohol in the blood for every unit measured on the breath. So the breathalyzer’s computer mistakenly multiplies the alcohol measured from the asthma inhaler 2100 times. So a very tiny amount of alcohol in the lungs from the inhaler mist can have a very large effect on the California DUI breath test machine’s reading.

A number of asthma inhalers can cause high scientific readings on breath machines due to the propellent gasses used in the aerosols, in particular, chlorofluorocarbons. See "Using Asthma Inhalers Can Give False Positive Results in Breath Tests", 324 British Medical Journal 756 (March, 2002). 1 of the design defects in California DUI breath machines is that they are non-specific as they falsely report thousands of different chemical compounds as being alcohol.

Some of these contain alot of alcohol. For example, Primatene Mist contains 34 percent alcohol.

Note there are experts who maintain that asthma inhaler's mist would dissipate over the required minimum 15 minute continuous observation period just prior to the California DUI breath test.

Let me first say that despite Rick's best efforts, I did not win my DUI case, though it was reduced to a wet reckless (and we did not prevail in the APS either). Despite that, I want to give Rick a great review.

By making these suggestions and giving me a LOT of information along the way, he helped me understand how both the APS and criminal courts worked and what would happen next. I got a DUI in San Diego with a Indiana prior. The courts found out about the IN prior, but the DMV did not. I told Rick that I needed to keep my license or else I would lose my job. I plead no contest to the courts, and have to do the required programs and fees. However, Rick won my DMV trial, and since they didn't know about my IN prior, I got my restricted license even after registering for the 18 month DUI program (for multiple convictions). As Rick will tell you, it can be frustrating not being involved with the day-to-day processes, but let Rick do his job. I have a lot of work to do for the court conviction, but with a 0.26 BAC, I really have to own up. All I care about is that he got my license back and I didn't lose my job (and don't have to spend cab fare on all of the programs I have to attend)!

Our statistical sobriety checkpoint shows that the inebriated people there have one of the highest death rates from alcoholic liver disease (per data from the Centers for Disease Control and Prevention). All a California DUI / DMV attorney has to do is prevail on one (1) DMV issue to save your first time offense license & you avoid any reissue fee and/or Proof of Insurance SR-22 filing! Here's what you should do within 10 days of being arrested:

10. If you need to save your driver's license or privileges, your attorney has only ten (10) calendar days to contact DMV!

Do not schedule yourself. If you contact DMV to schedule a date conflicting with your attorney's calendar, DMV will not reschedule and you may not get the attorney of your choice. There is no rush as long as your attorney contacts DMV by the 10th day from your arrest.

9. The ten (10) day time limit is computed from the Issue date of the SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE. If time is running out or you are late, contact an attorney ASAP.

8. This ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE is the California DMV paper which you should have received.

7. Even if you did not receive this DMV paper, the California DMV will probably take action against your driving privileges.

6. Even if you have a license from another state, and even if the officer did not take your license, that state may also take action against your driving privileges.

5. This TEMPORARY DRIVER LICENSE ENDORSEMENT is valid for only thirty (30) days from the issue date.

If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.

4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.

3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)

Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.

2. The DMV has the burden of proof to prevail on all three (3) issues. If DMV meets the burden of proof on two (2) issues, you win!
