City Councilor arrested for DUI medications in California

City Councilor Mary Flynn's Friday arrest on suspicion of driving under the influence was most likely due to prescription medications, not alcohol, Police Chief Bruce Hagerty said Monday.

Hagerty said he believed alcohol was not an issue when officers determined Flynn's driving was impaired Friday night after someone called to report her car resting against a wall of the Great Harvest Bread Co. on Forest Avenue.

"I just think she made a mistake in mixing several different medications," Hagerty said, referring to a recent medical procedure Flynn had undergone. He said she had medications with her in the car.

Flynn's attorney, Dennis Latimer, to whom she is referring questions, was in court on another issue Monday and could not be reached.

Hagerty said blood work taken at Enloe Medical Center following the incident was submitted to a lab Monday morning. The Chico Police Department will get a report from the lab in one to three weeks, he said. The test will reveal whatever substance was in the city councilor's system at the time.

"It's not illegal to drive a motor vehicle with prescription drugs in your system provided that they don't interfere with your ability to drive that vehicle safely. That's what will have to be determined regarding the charge of guilt or innocence regarding driving under the influence," Hagerty said.

However, he said there is no difference between alcohol, prescription drugs and illicit drugs in terms of their ability to impair driving. He said no matter what the substance is, the officer in the field determines through a number of field-sobriety tests whether the driver's ability is impaired.
"We have to pay attention to what that prescription bottle says," Hagerty said when asked for advice for others on prescription drugs.

Hagerty said warnings that prescription drugs can cause drowsiness or should not be taken while driving should be heeded.

However, he acknowledged drugs can have different effects on different people.

"It's an individual's decision on a person's part, and people make mistakes. I really think that's what she made, a mistake," he said.

Flynn, a Chico High School math teacher, was hired July 7 by Chico State University, confirmed Joe Wills, director of public affairs.

Flynn will serve in a full-time position as program administrator for the Community Action Volunteers in Education, an Associated Students program coordinating students who do volunteer work in the community.

She's in year two of her first four-year term on the City Council.

Hagerty said while determining innocence or guilt is more cut-and-dried for a DUI involving alcohol — a person is guilty of DUI when blood-alcohol content is .08 — there is no presumptive level for medications. Instead, a district attorney will use a combination of the blood work identifying the substance and the officer's opinion following field-sobriety tests to determine whether to press charges or drop the case.

Police got a call from someone inside the Great Harvest Bread Co. about 5:30 p.m. Friday reporting a car resting against the wall and saying a woman was involved in the incident, Hagerty said.

Officers found the front bumper of Flynn's car against the building, as if she were going to park and kept going, not crashing into but meeting the wall, he said.

He said there were scratches or minor damage to the wall, so officers took a traffic report to cover any damages the owner would need to claim.

Hagerty said Flynn was arrested, booked and processed Friday night and then released.

Flynn was arrested for DUI once before — in 1990. District Attorney Mike Ramsey said the law now requires those with previous DUIs within the last 10 years to receive enhanced punishment.

Checkpoint for DUI in California yields a couple of drunk driving arrests

California drunk driving attorneys report dozens of citations were doled out Friday night to motorists stopped at California drunk driving - DUI checkpoints in Vacaville and in Fairfield.

In Vacaville, the four-hour operation conducted at Depot and Bush streets resulted in 30 citations, 16 vehicle tows and two California drunk driving DUI-related arrests, California drunk driving police said.

In Fairfield, the California drunk driving checkpoint conducted in the 1300 block of Travis Boulevard resulted in six citations and three vehicle tows.

Prominent S.C. DUI defense attorney Reese Joye was found dead in a Cambridge, Mass., hotel room Sunday morning. He was 70. An Angel himself, he certainly has an impact wherever he is now.

Joye was attending an annual trial advocacy summer conference at Harvard University, which he had organized, and was set to return to Charleston on Sunday.

But when he didn’t come down for breakfast or answer his phone, his colleagues were concerned and sent hotel security to check on him.

His death appears to be from natural causes, said Ken Harrell, the family’s spokesman and one of Joye’s law partners.

He said Joye hadn’t shown any signs of illness.

“He had been in high spirits and had gone out to dinner the night before,” Harrell said.

In recent months he had also gone on ski trips and fly fishing trips, Harrell added.

“He really was in the best health he’d been in months.”

Joye’s family today will likely receive the medical examiner’s report naming an official cause of death.

His body will be flown to South Carolina today and Charleston’s Stuhr funeral home will handle the arrangements, Harrell said.

Joye, a lifelong South Carolinian, earned his bachelor’s and law degrees from the University of South Carolina.

He was instrumental in the debate in drafting the state’s DUI law over the past few years. In 2006, he was one of three attorneys asked to help draft legislation to replace S.C.’s DUI laws.

“Reese was a true advocate for what he believed in,” said state Sen. Brad Hutto, D-Orangeburg.

“He definitely made his presence known. Especially in the Legislature over the last decade.”

In 1970, Joye opened his private law practice in North Charleston.

An author of three books on drunken-driving laws and prosecution, Joye was a founding member and past president of the S.C. Association of Criminal Defense Lawyers.

“Reese was much more than a DUI defense attorney,” said Leland Greeley, the association’s current president.

Joye, he said, was a mentor to young attorneys.

“Basically we now have a void that will always be there,” he said.

“It will not be filled.”

Joye is survived by his wife, Jackie; three adult children and five grandchildren.

A DUI arrest an unusual turn when the suspect claimed to be a “black witch” and threatened to place a hex on the drunk driving arresting officers, Eagle Colorado DUI police said.

The 56-year-old woman first caught the attention of a patrolling officer when he had to swerve to avoid a head-on crash when her vehicle crossed into his lane on Broadway at about 8 p.m. Her car kept swerving and she was pulled over.

The woman behind the wheel had slurred speech and glassy eyes. She said she had consumed a couple of tequilas and was also taking methadone.

When she got out of her car, she was swaying. She initially refused to take a roadside drunk driving sobriety test, saying she was acting on the advice of her DUI defense lawyer.

When the DUI cops handcuffed and arrested her, she began yelling profanities and declared herself to be a “black witch.” She also threatened to hex the two officers involved. On the way to jail, she allegedly kicked and banged her head on the interior of the cop’s car.

She was charged with DUI, driving under suspension, resisting arrest, disorderly conduct, careless driving, and failure to display a valid license.

Riverside DUI Checkpoint for California

The following California DUI checkpoint information has been provided by the Riverside Police Department:

On Friday, July 18, 2008, the Riverside Police Department conducted a DUI/Drivers License checkpoint on Magnolia Avenue at Skofstad Street in the City of Riverside. Several Volunteers, Police Cadets and Explorers from the Department were on hand to assist with the California DUI effort.

Between the hours of 6:00 p.m. and 12 midnight, more than 2220 vehicles drove through the California DUI checkpoint. There were three (3) subjects arrested for California DUI, ninety-five (95) citations issued and seventy-one (71) vehicles were impounded. Several vehicles were inspected and one (1) cite was issued for illegally modifying their vehicle for street racing, per California DUI attorneys.

In addition, one (1) subject was arrested for delaying/obstructing an officer, one (1) for falsely identifying himself, one (1) for possession of Marijuana and one (1) subject entered the checkpoint having an open container of an alcoholic beverage, according to California DUI lawyers.

The Cypress Police Department will be conducting a DUI/Drivers License checkpoint on Saturday, July 19th, from 8:00 p.m. to 3:00 a.m., on Valley View at Lakeshore. In an effort to reduce the number of persons killed and injured in alcohol involved crashes, DUI checkpoints are conducted to identify offenders and get them off the street, as well as educate the public on the dangers of impaired driving.

All too often, members of our community are senselessly injured or killed on local roadways by impaired drivers. This DUI/Drivers License checkpoint is an effort to reduce those tragedies, as well as insuring drivers have a valid driver’s license. A major component of these checkpoints is to increase awareness of the dangers of impaired driving and to encourage sober designated drivers.

A DUI checkpoint is a proven effective method for achieving this goal. By publicizing these enforcement and education efforts, the Cypress Police Department believes motorists can be deterred from drinking and driving.

San Jose police will be conducting DUI and driver's license checkpoints tonight at undisclosed locations in the city.

From 9 p.m. to 3 a.m. drivers will be checked for valid licenses and those believed to be intoxicated or under the influence of alcohol or drugs will be arrested. Depending on traffic and weather conditions, all drivers may be checked at screening locations.

Motorists can be deterred from driving under the influence just by being notified of the potential check, police said.

The operation is funded by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

The Temecula Police Department conducted a DUI / DL checkpoint on July 12, 2008 from 6:00 PM to 2:00 AM at Rancho California x Promenade Chardonnay Hills in the City of Temecula. The purpose of this checkpoint was to check for impaired drivers and check driver’s license status.

1267 cars passed through the checkpoint, 19 cars were moved to a secondary examination area where 5 Field Sobriety Tests were administered. 2 adults were arrested for DUI, 5 cars were impounded, of these, 2 were impounded for 30 day holds from drivers without licenses.

Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration. The California Office of Traffic Safety and Temecula Police also want to remind you during the holiday season, if you choose to drink alcoholic beverages, please designate a sober driver before getting into a vehicle. California DUI lawyers report the Lake Elsinore Police Department conducted a DUI/Safety Checkpoint on Mission Trail and Campbell in the city of Lake Elsinore. The California DUI checkpoint was funded by a California DUI grant from the Office of Traffic Safety administered through the Traffic Safety Center at University of California, Berkeley. The California DUI checkpoint was in operation from 1800-2400 hours.

During the California DUI checkpoint hours, a total of 1300 vehicles were screened. Of these vehicles, 145 were diverted into the secondary screening area resulting in the issuing of 159 citations. 33 vehicles were towed or impounded due to unlicensed or arrested drivers. Six persons were arrested for California DUI - driving while under the influence, one person for public intoxication, one person for being possession of illegal drugs and one subject was arrested on an outstanding felony warrant. One Mexican National was found to be a previously deported felon and was arrested and surrendered to the U.S. Border Patrol.

This California DUI checkpoint was conducted with the assistance of Cal Fire as well as Lake Elsinore Police Department Explorers and Riverside County Sheriff Posse.

The Lake Elsinore Police Department will continue to conduct California DUI checkpoints funded by the grant through September, 2009. Throughout the county AVOID task forces in 25 cities participated in extra patrols and checkpoints, from which another 20 to 30 arrests are expected to be registered for Sunday, said California DUI lawyers.

There was also one fatality reported over the weekend. Alvaro Rodriguez, 38, was found dead behind the wheel of a burned-out car on the Golden State Freeway just south of Smokey Bear Road. It was not determined whether alcohol was involved or if Rodriguez succumbed to injuries from an accident that preceded the fire.
