CHP erases tape of witness who claims cop wanted bribe in connection with California DUI arrest - CHP said they were having fun and betting the BAC #
Shant Ohannessian, now facing a California Drunk Driving charge, claims that his passenger used his cell phone to make an audio recording of an officer who solicited a bribe, according to California DUI criminal defense lawyer / deputy PD Ben Maserang. He played the 7 minute recording which was allegedly erased by a CHP cop after he found out the conversation was recorded!
Trung Tran, who runs a computer data service, said he recovered two or three files of the recorded conversation and said Ohannessian told him that police had allegedly erased the recording.
On the tape, CHP Officer Keith Bianco is heard interrupting Ohannessian and suddenly injecting remarks about a “bet” twice:
“Now would you be willing to go to the ATM machine and withdraw 200 bucks and take that bet?” and “You’re not willing to take that $200 bet?”
“That’s a smart move on your part?” Bianco is heard saying.
CHP Officer Wood, who was present at the incident, maintains that Bianco had bet Ohannessian that he had a blood-alcohol level of more than .08 percent, the level at which a driver is presumed to be DUI in California.
“Sometimes, we joke and say things that we are not supposed to, but clearly it was a joke,” Wood said. “No money exchanged hands. Clearly it was a joke.”
Wood claims he can’t recall who told him the cell-phone recording was allegedly deleted or that he told a district attorney investigator that he learned of the recording from the 911 dispatcher. He opined that the body language and laughter indicated that they were allegedly having "fun." The Ventura defendant doesn't think it's funny.
CHP have recently been allegedly involved in some sort of form - fabricatation DUI evidence, including using template forms which suggest evidence, in DUI cases.
